STRATA HUB- NEW REGULATION UNDER
THE STRATA SCHEMES MANAGEMENT ACT 2015
New regulations under the Strata Schemes Management Act 2015, made by way of the Strata Schemes Management Amendment (Information) Regulation 2021 will impose new reporting requirements on strata schemes.
The Strata Hub is an initiative of the NSW Government to provide better transparency, accountability, better regulation and more engagement for owners and residents of strata schemes in NSW.
The hub will allow for key information to be accessible to schemes, service providers and the government, which will allow for better visibility of a strata schemes statutory requirements to help ensure well managed schemes.
Digital tools will facilitate proactive intervention and support as well as allow important messages to be delivered to schemes from emergency services, councils and regulators. Here it is important to note that private information WILL NOT be publicly available and only used by the regulators where necessary.
Under the Strata Schemes Management Amendment (Information) Regulation 2021, strata schemes will be required to report information each year via the Strata Hub online platform. Penalties for non-compliance apply for providing incorrect information and for not providing the information initially
A fee of $3 per lot is also payable to the NSW Fair Trading annually to cover administration and enforcement costs.
Currently, the initial report is required within three months from 30th June 2022.
Which information may be disclosed publicly?
a. the strata plan number of the strata scheme,
b. the date of registration of the strata plan for the strata scheme,
c. if the strata scheme is part of a community scheme—the date of registration and the number of the community plan, within the meaning of the,
d. if the strata scheme is part of a precinct scheme—the date of registration and the number of the precinct plan, within the meaning of the,
e. the address of the parcel of the strata scheme,
f. the total number of lots in the strata scheme,
g. the number of lots in the strata scheme used for the following purposes—
i. residential purposes,
ii. the purposes of a retirement village,
iii. commercial purposes,
iv. the purposes of a utility lot,
v. other purposes,
k. for a class 2 building, within the meaning of the Building Code of Australia, of the strata scheme—the number of storeys above ground level in the building,
r. the date of the most recent annual general meeting of the owners corporation,
Which information may only be disclosed to persons on the strata roll for the relevant scheme, secretary of the owners corporation, members of the strata committee and the building manager?
j. if an annual fire safety statement has been issued under the for a building of the strata scheme—the date the most recent statement was issued,
m. the following details of the secretary of the owners corporation—
i. full name,
ii. telephone number,
iii. email address,
n. the following details of the chairperson of the owners corporation—
i. full name,
ii. telephone number,
iii. email address,
o. if there is a strata managing agent appointed for the strata scheme—the following details of the agent—
